End of the Khmer Rouge and legal appraisal of their reign of terror
In 1994 the Khmer Rouge, which at that time still controlled around 20% of Cambodian territory, resumed the civil war. On July 7, 1994, the National Assembly declared the rebel organization “illegal”; thereupon the Khmer Rouge announced on July 11th the formation of a provisional government under Khieu Samphan based in the northern province of Preah Vihear. Mass desertions, the official break of individual leadership members with Pol Pot (in September 1996 peace treaty between the guerrilla units controlled by Ieng Sary and the government) and rivalry within the rebel organization (in June 1997 execution of Son Sen, then the establishment of Pol Potby own troops in the north-western jungle area) led to the rapid disintegration of the Khmer Rouge. The death of Pol Pot (April 15, 1998), the former supporters in the jungle base Anlong Veng had sentenced in July 1997 to life arrest by a “people’s court” (in the style of a show trial), the surrender of two other leaders of the rebel organization in December 1998 (Khieu Samphan and Nuon Chea), who were promised amnesty and who, like Ieng Sary, withdrew to the western Cambodian city of Pailin, and the military surrender of the remaining guerrilla units in late 1998 / early 1999 sealed the dissolution of the Khmer Rouge; her last in command Ta Mok was arrested in March 1999.
In 2001, Parliament and the Constitutional Council approved the establishment of an international tribunal in Cambodia to convict the main culprits of the Khmer Rouge regime; The UN and the Cambodian government agreed in March 2003 on joint steps to create such a court after years of negotiations that had been held for years and were temporarily interrupted (ratification of a corresponding law by the Cambodian National Assembly in October 2004). On July 3, 2006, the judges and prosecutors were sworn in for the tribunal in Phnom Penh to deal with the crimes of the Khmer Rouge (with Cambodian lawyers and lawyers commissioned by the UN); on February 17, 2009 the tribunal opened the first trial (against Kaing Guek Eav [Duch] [* 1942, † 2020], Head of the notorious Tuol Sleng Prison). The second process began at the end of June 2011. Nuon Chea, Khieu Samphan and Ieng Sary have all been charged with war crimes, crimes against humanity and genocide. Ieng Thirith (* 1932, † 2015), the former Minister of Social Affairs and wife of Ieng Sary, who was also accused, was declared incapable of litigation because of dementia and was released in 2012. That same year, a special tribunal revision chambersentenced Kaing Guek Eav to life imprisonment for crimes against humanity and war crimes. Also Nuon Chea and Khieu Samphan were sentenced to life imprisonment on August 7, 2014.
